Six Privacy Commitments Escala Makes to Every Player

Plain-language summary of how Escala handles your personal information.

We Only Collect What We Need

Escala collects personal data only to the extent required to operate your account, process payments, meet our PAGCOR licensing obligations, and comply with the Philippine Data Privacy Act (RA 10173). We do not collect data speculatively or for resale.

We Never Sell Your Data

Escala does not sell, rent, or trade your personal information to third parties for marketing or commercial purposes. Your data is used exclusively to run the Escala platform and to comply with Philippine regulatory requirements.

256-Bit Encryption at All Times

All data transmitted between your device and Escala's servers is protected with 256-bit SSL/TLS encryption — the same standard used by major Philippine banks. Stored personal and financial data is encrypted at rest using industry-standard AES-256.

Your Rights Are Respected

Under RA 10173, you have the right to access, correct, and erase your personal data, and to object to certain types of processing. Escala provides clear, free, and accessible channels to exercise every one of these rights.

Data Stays in the Philippines

Escala's primary data processing infrastructure is based in the Philippines. Where data is processed by third-party providers located outside the Philippines, we ensure appropriate safeguards are in place consistent with RA 10173 requirements.

Breach Notification Within 72 Hours

In the unlikely event of a personal data breach affecting your information, Escala will notify the National Privacy Commission (NPC) and affected Players within 72 hours of becoming aware of the breach, as required by law.

About This Policy

This Privacy Policy applies to all personal data processed by Escala in connection with the escala.best platform, including account registration, gameplay, financial transactions, customer support interactions, and marketing communications. It is written in plain English so that every Filipino player can understand exactly how their information is handled. If you have questions after reading this, contact our Data Protection Officer at privacy@escala.best.

1

Who We Are

Escala has appointed a Data Protection Officer (DPO) responsible for overseeing data protection compliance. You can contact the DPO at any time via email at privacy@escala.best or through the live chat available in your Escala account dashboard.

By registering an account and using the Escala platform, you acknowledge that your personal data will be processed in accordance with this Privacy Policy. If you do not agree with the terms of this policy, please do not use the Escala platform.

How We Collect Your Data

Escala collects personal data through the following channels:

  • Directly from you — when you register an account, complete KYC verification, make a deposit or withdrawal, contact customer support, respond to a survey, or participate in a promotion.
  • Automatically through your use of the platform — through cookies, web beacons, server logs, and similar tracking technologies when you access escala.best or use the Escala app. See Section 9 for full details on cookies.
  • From payment providers — GCash, Maya, and other payment processors may share transaction confirmation data and payment method details with Escala as part of the payment processing flow.
  • From identity verification services — Escala uses third-party KYC and identity verification providers to cross-check information you provide against official Philippine government databases, consistent with PAGCOR licensing requirements.
  • From fraud prevention services — Escala uses third-party fraud detection tools that may receive and process technical data (IP addresses, device fingerprints) to protect the platform and its players.
4

Legal Basis for Processing

Under RA 10173, Escala processes your personal data on the following legal bases:

  • Contractual necessity — processing required to create and manage your Escala account, process transactions, and deliver the gaming service you have requested.
  • Legal obligation — processing required to comply with PAGCOR licensing conditions, the Anti-Money Laundering Act (RA 9160), the Data Privacy Act (RA 10173), and other applicable Philippine laws.
  • Legitimate interests — processing conducted for fraud prevention, platform security, responsible gaming monitoring, and service improvement, where these interests are not overridden by your data protection rights.
  • Consent — for optional processing activities such as marketing communications and certain personalisation features, where Escala relies on your freely given, informed consent. You may withdraw consent at any time.
5

How Escala Uses Your Personal Data

Your personal data is used by Escala for the following specific purposes:

  • Account management — creating, maintaining, and securing your Escala account; processing password resets and security alerts.
  • Financial transactions — processing deposits and withdrawals through GCash, Maya, and other supported payment channels; generating transaction records for your account history.
  • Identity and age verification — confirming that you are who you say you are and that you meet the 21-years-minimum age requirement under Philippine law.
  • Regulatory compliance — meeting Escala's obligations under PAGCOR conditions, the AMLA, and RA 10173; generating records required for regulatory audits and inspections.
  • Fraud prevention and platform security — detecting and preventing cheating, multi-accounting, money laundering, and other prohibited conduct described in the Escala Terms and Conditions.
  • Responsible gaming — monitoring gameplay patterns that may indicate problem gambling; delivering responsible gaming tools and communications; responding to self-exclusion requests.
  • Customer support — handling account queries, payment disputes, game result questions, and complaints through live chat and email.
  • Platform improvement — analysing usage data in aggregate to improve game selection, navigation, load times, and the overall Escala player experience.
  • Marketing communications — where you have consented, sending promotional emails or in-platform notifications about Escala bonuses, new games, and events relevant to you.

Escala does not use personal data for automated individual decision-making that produces legal or similarly significant effects, except where required by law (for example, AMLA-triggered account freezes) or where you have given explicit consent.

6

Sharing Your Personal Data

Escala shares personal data only in the circumstances listed below. We do not sell your data to anyone, ever.

  • Payment processors — GCash (GXI), Maya (PayMaya Philippines), GrabPay, Coins.ph, Bancnet member banks, Visa/Mastercard networks. Data shared is limited to what is necessary to process your specific transaction.
  • KYC and identity verification providers — third-party services used to verify your identity documents against Philippine government databases. These providers process your data solely for verification purposes and are bound by strict confidentiality obligations.
  • Fraud detection and security services — providers that help Escala identify suspicious account activity, multi-accounting, and potential money laundering. Technical and usage data may be processed by these providers.
  • Game providers — JILI Games, Evolution Gaming, and other certified game providers receive minimum necessary technical data (e.g., player session tokens) to deliver their games within the Escala platform. They do not receive your full identity or financial data.
  • Regulatory authorities — PAGCOR, the Anti-Money Laundering Council (AMLC), the National Privacy Commission, and other Philippine government bodies where disclosure is required by law or court order.
  • Legal and compliance advisers — where Escala requires legal advice in connection with a regulatory matter, dispute, or litigation involving your account. These advisers are bound by professional confidentiality obligations.

Any third party that receives personal data from Escala is required to process that data only for the specified purpose and to maintain appropriate security measures. Escala remains responsible for ensuring third parties comply with applicable data protection law.

7

How Long We Keep Your Data

Escala retains personal data for the minimum period required by our legal and regulatory obligations, after which it is securely deleted or anonymised.

  • Account data — retained for the duration of your Escala account, plus a minimum of 5 years after account closure, as required by PAGCOR and AMLC regulations.
  • Financial transaction records — retained for a minimum of 5 years after the transaction date, consistent with AMLA requirements.
  • KYC and identity verification documents — retained for the duration of the account relationship plus 5 years after closure.
  • Customer support communications — retained for 3 years after the support interaction is closed, to support dispute resolution and quality improvement.
  • Technical and usage data — aggregated and anonymised after 13 months; raw logs retained for up to 6 months for security monitoring purposes.
  • Marketing consent records — retained until consent is withdrawn, plus a reasonable period thereafter to demonstrate compliance.

Where a legal dispute, regulatory investigation, or formal complaint is active, Escala will retain relevant data for the duration of that proceeding regardless of standard retention periods.

How We Protect Your Data

Escala implements a layered security framework to protect your personal data from unauthorised access, disclosure, alteration, and destruction:

  • Encryption at rest — databases containing personal and financial data are encrypted using AES-256.
  • Access controls — access to personal data is restricted to Escala staff and contractors on a strictly need-to-know basis, enforced through role-based access controls and multi-factor authentication.
  • Network security — Escala's infrastructure is protected by enterprise-grade firewalls, intrusion detection systems, and DDoS mitigation.
  • Regular security audits — Escala undergoes regular penetration testing and security audits conducted by independent third-party specialists.
  • Employee training — all Escala staff who handle personal data receive mandatory data privacy training and are bound by confidentiality obligations in their employment contracts.

No security system is completely infallible. In the event of a data breach, Escala will respond in accordance with RA 10173 obligations, notifying the National Privacy Commission and affected Players within 72 hours where required.

Right to Access

You can request a copy of all personal data Escala holds about you. We will provide this in a commonly used electronic format within 15 business days of your request, free of charge for one request per year.

Right to Rectification

If any personal data Escala holds about you is inaccurate or incomplete, you have the right to have it corrected. Many details can be updated directly in your Escala account settings.

Right to Erasure

In certain circumstances you can request that Escala delete your personal data. This right is subject to our legal obligations — we cannot delete data that we are required to retain under PAGCOR or AMLA regulations.

Right to Object

You can object to Escala processing your personal data for marketing purposes or where we rely on legitimate interests. We will stop processing unless we have compelling legitimate grounds that override your interests.

Right to Restrict Processing

You can request that Escala temporarily restrict processing of your personal data — for example, while you contest the accuracy of the data or the lawfulness of our processing.

Right to Data Portability

Where processing is based on your consent or a contract, you can request your personal data in a structured, machine-readable format suitable for transfer to another service provider.

NPC Complaints

If you are not satisfied with how Escala has responded to a data rights request or a privacy concern, you have the right to lodge a complaint with the National Privacy Commission (NPC) of the Philippines. Contact our DPO first at privacy@escala.best — we will do our best to resolve any concern directly before NPC involvement becomes necessary.

11

Marketing & Promotional Communications

With your consent, Escala may send you promotional emails, SMS, and in-platform notifications about new games, bonuses, special events, and other Escala offers relevant to your interests as a Filipino player.

You are never obliged to receive marketing communications. When you register, you will be given a clear choice to opt in or out of marketing. You can change your marketing preferences at any time:

  • In your Escala account settings under "Communication Preferences"
  • By clicking the unsubscribe link in any Escala marketing email
  • By contacting our support team via live chat or at support@escala.best

Withdrawing marketing consent will not affect the processing of personal data for account management, payment processing, or regulatory compliance purposes, nor will it affect any bonuses already credited to your account.

Escala does not use your personal data for third-party marketing. We do not share your contact details with external advertisers or affiliate networks for them to contact you directly.

12

Children's Privacy

The Escala platform is strictly for adults aged 21 and above, as required by Philippine gaming law. Escala does not knowingly collect personal data from anyone under the age of 21.

If you believe that a person under 21 has registered an Escala account, please contact us immediately at support@escala.best. Upon verification, we will close the account, return any deposits to the source, delete the minor's personal data from our systems, and report the matter as required by PAGCOR regulations.

Age verification is performed on all Escala accounts before real-money play is permitted. Accounts that cannot be verified as belonging to a person aged 21 or older will be suspended pending verification.

13

Cross-Border Data Transfers

Escala's primary data processing infrastructure is located in the Philippines. In certain circumstances, personal data may be processed by third-party service providers — such as game providers or security vendors — whose servers are located outside the Philippines.

Where such cross-border processing occurs, Escala ensures that appropriate safeguards are in place to protect your personal data to a standard equivalent to that required by RA 10173. These safeguards include:

  • Standard contractual clauses that bind the receiving party to RA 10173-equivalent data protection obligations.
  • Transfer only to service providers that Escala has assessed as maintaining adequate technical and organisational security measures.
  • Limiting the personal data transferred to what is strictly necessary for the third party's specific function.

If you would like information about which specific third parties may process your data outside the Philippines, contact our DPO at privacy@escala.best.

14

Changes to This Privacy Policy

Escala may update this Privacy Policy from time to time to reflect changes in our data practices, new legal requirements, or improvements to our platform. When material changes are made — those that affect your rights or how your data is used in a significant way — we will notify you by email and/or in-platform notification at least 7 days before the updated policy takes effect.

The "Last Updated" date at the top of this page always reflects the date of the most recent revision. We encourage you to review this policy periodically to stay informed about how Escala protects your personal information.

Continuing to use the Escala platform after a revised Privacy Policy takes effect constitutes your acknowledgment of the updated policy. If you do not accept the revised terms, please stop using Escala and contact us to close your account.

Common Privacy Questions at Escala

Quick answers to what Filipino players most often ask about data privacy at Escala.

Escala shares data with Philippine government bodies — including PAGCOR, the AMLC, and the NPC — only when required by law or a valid court order. This is not optional: as a PAGCOR-licensed operator, Escala is legally obligated to cooperate with regulatory and law enforcement authorities when presented with a lawful request. We do not proactively share data with government bodies beyond what our licence conditions require.

Yes. Under your rights as a data subject under RA 10173, you can submit a Subject Access Request to privacy@escala.best at any time. Escala will provide a complete copy of your personal data in a commonly used electronic format within 15 business days. The first request per 12-month period is free. Subsequent requests may be subject to a reasonable administrative charge.

Your GCash number and transaction details are transmitted to Escala's payment systems using 256-bit SSL encryption. GCash transaction data is stored in encrypted databases with access strictly limited to payment processing staff. Escala does not store your full GCash account credentials — only the minimum payment reference information necessary to process and reconcile transactions. GXI (the operator of GCash) processes the actual payment separately under their own data protection framework.

You can unsubscribe from Escala marketing emails at any time by clicking the unsubscribe link at the bottom of any marketing email, or by updating your communication preferences in your account settings. You can also contact our support team via live chat to opt out. Once you unsubscribe, marketing emails will stop within 5 business days. Please note that transactional emails — such as deposit confirmations, withdrawal notifications, and security alerts — are not affected by unsubscribing from marketing.

When you close your Escala account, your data is retained for a minimum of 5 years after closure as required by PAGCOR licensing conditions and the Anti-Money Laundering Act. After this mandatory retention period, your personal data is securely deleted or fully anonymised. During the retention period, your data is stored securely and is not used for any marketing or commercial purpose. If you request account closure for responsible gaming reasons (self-exclusion), your data will be retained for the exclusion period to prevent re-registration.
